1. Warranty to the treatment provider Herewith Nobel Biocare gives certain warranties depending on the product that was purchased:
1.1 Implants: Nobel Biocare guarantees that, if any Nobel Biocare implant installed after July 1, 2000, fails to remain in the bone in which it is implanted during the 10 year period* after the original Nobel Biocare implant is installed, Nobel Biocare will replace the implant and restorative components, placed on the implant at the time of failure, with the same Nobel Biocare implant and restorative components at no charge (the only possible changes are related to diameter and/or length). In case one of the products is no longer commercially available, an alternative solution can be chosen. Restorative components may consist of an implant, cover screw, healing abutment, permanent abutment, prosthetic screw and/or prosthetic cylinder, depending on the components which were installed in the failed implant site.
1.2 NobelProcera Products on teeth and implants: Nobel Biocare guarantees that, if any NobelProcera Product on teeth and implants fails after being placed in the patient’s mouth, Nobel Biocare will replace the respective NobelProcera Product during a 5 year period. This NobelProcera Product warranty only covers the NobelProcera Product and does not include any additional costs. The warranty does not include temporary or provisional restorations. 2. Warranty to the patient Specifically for NobelProcera Implant Bar Overdenture (Patient Guarantee Card): Nobel Biocare guarantees to the patient that, if any NobelProcera Implant Bar Overdenture fails after being placed in the patient’s mouth, Nobel Biocare will replace the respective NobelProcera Implant Bar Overdenture during the 5 year period. This NobelProcera Implant Bar Overdenture warranty only covers the NobelProcera Implant Bar Overdenture and does not include any additional costs. 3. Eligibility For the treatment provider in general or in the case of NobelProcera Implant Bar Overdenture the patient to receive the benefits described above, a treatment provider** must:
3.1 Have used only original Nobel Biocare surgical and prosthetic components in the patient case in which the Nobel Biocare product failure occurred, including implants, cover screws, healing abutments, permanent abutments, prosthetic screws, prosthetic cylinders, crowns, bridges and bars.
3.2 Have performed the treatment in accordance with Nobel Biocare’s prescribed procedures and instructions as published at the time of such treatment and in accordance with accepted dental practice. Contraindicated implant and restorative techniques as described in procedures and instructions published by Nobel Biocare will make the Warranty null and void.
3.3 For NobelProcera products in particular: Have complied with the handling and material instructions of Nobel Biocare as published at the time of preparation, design and finishing. Non-compliance with the procedures and instructions published by Nobel Biocare will make the Warranty null and void.
3.4 Ensure that the patient complies with generally accepted standards of good oral hygiene. Implants and NobelProcera restorations that fail as a result of poor hygiene maintenance and/or infections may not be covered under the program. For implants, oral hygiene maintenance examinations twice a year are recommended.
3.5 Be current in any payments owing to Nobel Biocare or any affiliated company at the time an Implant Failure Guarantee Questionnaire or NobelProcera complaint is submitted.
Nobel Biocare shall not be obliged to furnish benefits under this Warranty Program with respect to any Nobel Biocare implant if the failure of such an implant or NobelProcera product is caused by trauma or by the patient in whom such an implant was installed.
This Warranty does not apply to any products that are specially manufactured or modified at the request of the treatment provider nor does it apply to the Immediate Provisional Implant (IPI) System, the Smooth Staple Implant System or any other temporary implant system distributed by Nobel Biocare. * For Sweden, Norway, Denmark, Finland and Iceland life time period applies. ** Treatment providers include dentists, physicians and dental technicians. 4. Claims Send a signed, stamped and completed Implant Failure Guarantee Questionnaire accompanied by the failed product and the other components placed by the treatment provider to Nobel Biocare within three months after the implant failure occurred. The X-Ray of the failed implant is mandatory. Prior to submitting the implant and the other components used in the treatment, ensure that all the products are sterilized.
For NobelProcera products complaint orders must be sent using the NobelProcera Software with the original file name(s) and the appropriate complaint code(s). For NobelProcera Implant Bridges the complaint questionnaire must be filled out. 5. Modification or Termination of Warranty Program Nobel Biocare may modify or terminate this Warranty Program at any time. Changes to or the termination of the Warranty will not affect guaranteed products installed prior to the date of the change or termination. 6. Limitations on Warranty Program EXCEPT FOR THE WARRANTY DESCRIBED IN PARAGRAPH 1 ABOVE, NEITHER NOBEL BIOCARE NOR ANY AFFILIATED COMPANY WHICH MANUFACTURES OR DISTRIBUTES ANY NOBEL BIOCARE COMPONENTS MAKES ANY WARRANTY WITH RESPECT TO NOBEL BIOCARE COMPONENTS, EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED GUARANTEES OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE.
In addition, Nobel Biocare and all such affiliates disclaim all liability to a treatment provider for lost earnings, income or profits, failure of a treatment provider to conform to generally accepted standards of dental practices and all other direct or indirect, incidental or consequential damages resulting or arising from the design, composition, condition, use or performance of Nobel Biocare components. 7. Application of Warranty This Warranty is exclusively for the benefit of eligible treatment providers and is not for any other person or entity, including any patient except for the warranty given directly to the patient in paragraph 1 above. 8. Entire Agreement Except as set forth herein, neither Nobel Biocare nor any affiliate of Nobel Biocare makes any representation, warranty, covenant or other undertaking relating to Nobel Biocare products and this Warranty sets forth the entire understanding and supersedes all prior agreements and discussions relating to the subject matter contained herein.
This Warranty is applicable through all Nobel Biocare.
