All intellectual property rights (IPRs) in the Nobel Biocare Products are and shall remain the exclusive property of Nobel Biocare or its licensors, as applicable. Nobel Biocare Products may be covered by one or more of the patents listed in the Patent Marking Document.
Implants are sold subject to a license to use IPRs only in conjunction with original Nobel Biocare Products. Use of Nobel Biocare implants together with non original Nobel Biocare Products is a breach of the license - to only use IPRs in any Nobel Biocare implant together with original Nobel Biocare Products - and constitutes an infringement of IPRs.
The Products may be protected by patents that cover the use of a certain Product in combination with one or more other Products. Please refer to the patent marking document in question for a list of applicable patent information. Purchase of a genuine Nobel Biocare Product includes a license to combine that Product with other genuine Nobel Biocare Products as part of a patented combination, including the combination claimed in U.S. Patent No. 6,733,291. Such license does not extend to combinations with non Nobel Biocare Products. No oher manufacturer is authorized to grant such a license. Unless expressly authorized by Nobel, purchasers of genuine patented Nobel Biocare Products are prohibited from re-selling these Products other than to Patients (or as permitted by compulsory law), and are also prohibited from exporting genuine Nobel Biocare Products to countries where such Products are protected by patents.
Nobel Biocare will defend, indemnify, and hold customers harmless from any money judgement (including costs and attorney fees) finally awarded or settled, to the extent such are due to a claim that the Products, as provided by Nobel, infringes a right of any third party. This indemnity is subject to Nobel Biocare being provided prompt notice of such claim and being granted full control of the defence or settlement thereof.
